Copyright, Pornography and the Moral Rights of the Pornographer
A radical, revisionist examination of the concept of "moral rights" inherent in principles of author/work integrity in copyright law as systematically violated by Australia's film classification and censorship system in violation of the nation's responsibilities to International Law. The essay juxtaposes the concept of authorital integrity in relation to specifically pornographic / sexually explicit / transgressive works (primarily film) with the notions of "offence to a reasonable adult" used by Australian cnesors to justify their suppression of ideological discourse threatening to, and aesthetic devices deliberately transgressive of, the Christian morality underlying Australia's censorship system - historically the strictest of any so-called "democracy". The essay examines the practices and standards of the means of bureacratic censorship as an Australian institution which in effect denies copyright integrity to any work unless it conforms to acceptable standards of aesthetic and ideological discourse before being the granted to be freely disseminated to the Australian populace, a procedure which puts Australia firmly at odds with UN Article 19 and the right to freely seek out information "regardless of frontiers". The Integrity of Aberration was librarian, film scholar and ALIA member Robert Cettl's assessment of the legal issues impacting an objective study of pornography and adult cinema in Australia and would be raw material for the elucidation of pornography as Transgressionism and sexually explicit material as the "aesthetics of offence" in the subsequent report into library ethics, pornography and censorship in Objective Material.
